Do not approve this faulty agreement! As I stated at the 1/18/11 meeting it will be impossible for Andersen to do any work on the detention pond with out violating the 30 foot diameter (or is it a 30 foot radius which would be even worse) restriction from the trees on the south property line. Sheet 12 of C M Lavoie's plan date 8/8/05 shows the trees 5 feet south of the property line and even there it is impossible to do any work within the limits stated at the meeting. It is my understanding and to make matters even worse the trees are on the property line. As you can plainly see the work starts at the property line so any work done there will impact the trees. To move the detention pond will reduce the capacity of the pond unless the size of the lots 9, 10 & 11 are reduced. These lots are less than 50 feet now. Sandack's snide remark about letting the engineers figure it out is insulting. I am a licensed Architect and can read drawings and have worked with topo surveys and even prepared them. This is so apparent that even a fool can see that it is not right, just look at the drawing. I did not see anything in the write-up about the 30 foot set back. So where does this requirement appear and how is it enforceable? Who will check out the calculations of the pond, our staff or the counties? Frank C. Falesch Architect |
