Subject: Nelson Meadow Subdivision Agreement John, I've received and considered both of your notes relating to the Nelson Meadow project. And while I appreciate your obviously passionate interest in this job I do not agree with your suggestion(s) that the issues you raise are rightly addressed via the Council and the request to amend the development. Your initial concern regarding the trees is already addressed in sufficient manner and in a portion of the agreement that is not part of the requested amendments. Construction site access is an issue which I believe should be determined through discussions between the developer, his contractor and the Village Community Development and Engineering Departments who would be acting on behalf of the Village and our residents. These projects tend to have an ebb and flow to them and there is much about the execution of the work process and final product that depend upon decisions made by our Village staff along the way. I have confidence in our current staff and do not believe it is appropriate, efficient or effective to try and codify much beyond intent, authority and ultimate responsibility - both of which are clearly defined within this agreement.
