Subject: Nelson Meadow property development, followup for the Feb 20 meeting

Dear Commissioners,

 

We have attended the various Planning Commission meetings regarding the development of the Nelson property and have voiced our concern during those proceedings.  We still have those same concerns as follows:

 

  1. We moved to this location in 1999 because of the “country” feel and large, developed land with abundant trees and flowers.  The new Nelson Meadow proposal is for much larger houses on lots that average ˝ the size of our adjacent properties with no substantial trees for the next 20 years.

 

  1. We are concerned about both storm water runoff as well as sanitary sewer backup – both of which have been ongoing problems since we have moved in. 

 

·    We understand that the Sanitary District is not planning any sewer upgrades even though we have reported sewer backups.  The new houses higher than our adjacent properties can only make the problem worse. 

 

·     We walked through the neighborhood with Mayor Krajewski and pointed out the current storm water situation.  The new detention pond does not address current runoff problems that result from St. Joseph Creek backups during heavy rains.

 

Regarding the issues stated in the Manager’s report for the Feb 20 meeting:

 

  1. If the owner of the “lot8” property will be solely responsible for maintenance of the stormwater detention pond. Will this ensure:
            a.       cutting and/or maintaining vegetation on the steep slope?

b.      mosquito & bacteria testing and abatement?

c.       maintenance of inlet pipes into the detention pond to ensure that storm water doesn’t overflow into the overloaded Jefferson avenue storm sewers?

d.      maintenance of the 7ft tall retaining wall?

e.       maintenance of the railing along the walking path above the detention pond?

f.        maintenance of the detention area until a permanent resident is onsite?

g.       Who can we contact in the event of future problems with the detention area?

h.       What legal protections will neighbors have in the event that the detention area is not properly maintained?

i.         Who will determine what “proper“ maintenance is required and how often?

 

 

We sincerely request your support in finding resolutions to these issues that can have a positive affect on our neighborhood.
